I. Agreement to Terms

These Terms & Conditions (“Terms”) constitute a legally binding agreement made between you (“you”, “Customer”) and VisothKH (“VisothKH”, “we”, “us”, “our”).
By accessing https://www.visothkh.com/ (the “Site”) or purchasing any product, you confirm that you have read, understood, and agreed to be bound by these Terms.
If you disagree with any part of these Terms, you must discontinue use of the Site immediately.

II. About VisothKH

  • Legal status: Sole-proprietor online store (not yet business-registered)

III. Use of the Site

  1. You must be at least 18 years old or have parental consent to place an order.
  2. You agree not to:
    • violate any applicable Cambodian or international law;
    • attempt to gain unauthorised access to the Site, servers, or user data;
    • use robots, spiders, scraping, or similar techniques to mine data;
    • transmit malware, viruses, or harmful code;
    • interfere with any security-related feature or normal Site operation.
  3. We may, at our sole discretion, suspend or terminate your access for violation of these Terms.

IV. Product Information

  1. All photographs, dimensions, and descriptions are provided in good faith for illustrative purposes; minor colour or pattern variations may occur.
  2. Stock levels are updated in real time; however, rare discrepancies can arise. If an item becomes unavailable after you place an order, we will cancel the order and refund any payment in full.

V. Ordering Process

  1. Checkout data: name, mobile number, shipping address, (optional) e-mail.
  2. OTP verification: You confirm each order via a one-time code sent to your phone.
  3. An order becomes binding only after (a) successful payment via ABA PayWay and (b) our explicit order-confirmation e-mail/SMS.
  4. We reserve the right to limit or cancel quantities where fraud, error, or unfair practice is suspected.

VI. Pricing & Payment

  1. All prices are quoted in US Dollars (USD) and are inclusive of applicable VAT (if any).
  2. VisothKH accepts ABA PayWay exclusively. You are redirected to ABA’s secure gateway; VisothKH never receives or stores card details.
  3. Prices may change at any time, but confirmed orders retain the price displayed at checkout.
  4. Title to the goods passes to you when we receive full cleared payment.

VII. Shipping & Delivery

Please inspect the parcel on delivery; note any visible damage with the driver and notify us within 24 hours.

VIII. Cancellations, Returns & Refunds

  1. Cancellations before dispatch – E-mail us immediately; if the parcel has not left our premises we will void the transaction and refund you in full.
  2. Defective or damaged items
    • Notify us within 7 days of delivery via e-mail with clear photos.
    • Remedies: (i) replacement (stock permitting) or (ii) full refund to the original payment method.
  3. Change-of-mind – Not accepted, owing to the fragile nature of ceramics and custom protective packaging.
  4. Returned items must be unused, complete, and in original packaging. Unless we shipped the wrong or defective product, you bear return shipping costs.

IX. Intellectual Property

All images, logos, graphics, product names, and code on the Site are the property of VisothKH or its content suppliers and are protected under Cambodian and international copyright and trademark laws.
No content may be copied, reproduced, or distributed without our prior written consent.

X. Disclaimer

THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE FULLEST EXTENT PERMITTED BY LAW, VISOTHKH MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

XI. Limitation of Liability

In no event shall VisothKH, its owner, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the Site or purchase of products.
Our aggregate liability shall in no case exceed the total amount you paid for the specific order giving rise to the claim.

XII. Indemnification

You agree to defend, indemnify, and hold harmless VisothKH and its owner against any claims, losses, damages, liabilities, costs, or expenses (including legal fees) arising out of your breach of these Terms or your violation of any law or third-party right.

XIII. Modifications & Interruptions

We reserve the right to change, modify, or remove the contents of the Site and these Terms at any time.
We cannot guarantee the Site will be available at all times and may experience outages or hardware, software, or other problems. We shall not be liable for any inconvenience or loss caused by such interruptions.

XIV. Governing Law & Jurisdiction

These Terms and any dispute are governed by the laws of the Kingdom of Cambodia.
Both parties submit to the exclusive jurisdiction of the Phnom Penh Municipal Court.
